Date: Feb. 14, 11:15am. The Commonwealth's 4:00 p.m. Burning Law goes in effect February 15th- April 30th the start of spring fire season. No one can burn before 4:00 p.m. if the fire is in, or within 300 feet of woodland, brushland or fields containing dry grass or other flammable material. Residents are allowed to burn between 4 p.m. and midnight as long as long as proper care and precautions are considered. Fires must be attended at all times.
The 4 p.m. Law was adopted to reduce the number of wildfires which occur each spring. After 4 p.m. winds usually calm down and the relative humidity levels are on the increase, both of which reduce the potential for a debris fire or any outdoor open air fire that may get out of control.
The public should also be aware that although the burning is conducted with permission and by the regulations, they are not exempt from any consequences, liability, damages or injuries which may result from the burning.
If the burning becomes a smoke or ash nuisance or upon declaration of an alert, warning, or emergency conditions, all burning may be halted.
A violation of this law is a Class 1 misdemeanor punishable by a fine not to exceed $2,500 or imprisonment not exceeding 12 months or both.
